WELCOME TO THE SKATINGER ONLINE STORE

These Terms of Sale explain the purchasing, ordering, payment, delivery, withdrawal, return and complaint procedures applicable to purchases made through the SKATINGER EU online store:

These Terms of Sale may also apply to localised SKATINGER online stores where KB SPORT SISTEM d.o.o. is expressly identified as the seller, including:

The websites listed above are collectively referred to as the “Websites”.

Before submitting an order, please read these Terms of Sale, our General Terms and Conditions, Privacy Policy, Cookie Policy and the information displayed during checkout.

Mandatory consumer rights provided by applicable European Union and national law are not excluded or restricted by these Terms of Sale.

1. SELLER INFORMATION

The seller of the products offered through the Websites and the Customer’s contracting party is:

KB SPORT SISTEM d.o.o. is hereinafter referred to as the “Seller”, “KB SPORT SISTEM”, “we”, “us” or “our”.

The Websites are technically operated through the Connect Marketplace e-commerce platform. Connect Marketplace provides the technical infrastructure for customer accounts, shopping carts, checkout, ordering, databases, system administration and related online-store functions.

Unless another seller is expressly identified in connection with a particular offer or during checkout, the sales contract is concluded exclusively between the Customer and KB SPORT SISTEM d.o.o.

2. CONSUMERS AND BUSINESS CUSTOMERS

The Websites are intended for both Consumers and Business Customers.

A “Consumer” is a natural person purchasing products for purposes that are predominantly outside that person’s trade, business, craft or professional activity.

A “Business Customer” is a natural or legal person purchasing products within its commercial, business, craft or professional activity.

Consumers and Business Customers are collectively referred to as “Customers”, except where a provision expressly applies only to one group.

Statutory consumer rights, including rights relating to withdrawal, delivery and non-conforming products, do not apply to Business Customers unless mandatory law or an individual agreement provides otherwise.

3. SHOPPING WITH OR WITHOUT REGISTRATION

Customers may purchase products using a registered customer account or, where available, as a guest without registration.

A registered customer account may allow the Customer to:

  • save billing and delivery addresses;
  • view current and previous orders;
  • track order status;
  • save selected products and preferences;
  • manage personal and communication settings;
  • use other functions available through Connect Marketplace.

The Customer may specify different billing and delivery addresses. Products will be delivered to the selected delivery address, while the invoice will contain the billing information entered during checkout.

Information entered during registration or checkout must be complete, current and accurate.

Registered Customers are responsible for keeping their login credentials confidential and preventing unauthorised access to their accounts.

Suspected unauthorised access or misuse of a customer account must be reported immediately to: info@skatinger.eu.com .

A customer account may form part of the shared Connect Marketplace system and may provide access to several connected online stores. Each purchase is nevertheless concluded with the seller expressly identified in the relevant store and checkout process.

4. PRODUCT SELECTION AND SHOPPING CART

Products can be selected by opening the relevant product page, choosing the desired model, variant, size, colour and quantity, where applicable, and adding the product to the shopping cart.

The shopping cart allows the Customer to:

  • review selected products;
  • change quantities;
  • remove products;
  • apply an eligible promotional code;
  • review the estimated product total;
  • proceed to checkout.

Placing a product in the shopping cart does not reserve the product and does not create a sales contract.

Products remain subject to availability until the Customer’s offer has been accepted by the Seller.

5. PRODUCT INFORMATION AND AVAILABILITY

We make reasonable efforts to ensure that product descriptions, photographs, dimensions, technical information, available variants and included accessories are accurate.

Minor differences may arise due to:

  • screen and colour settings;
  • lighting used during product photography;
  • normal manufacturing tolerances;
  • minor technical improvements;
  • changes in packaging;
  • minor material or colour variations that do not affect functionality.

The product included in the order is determined by the product description, selected model, variant, dimensions, colour, quantity and included accessories displayed in the final order summary.

Availability and delivery-time information is based on information available when the order is placed and may change before the sales contract is concluded.

If a product becomes unavailable after the Customer has submitted an order, the Customer will be informed without undue delay.

Any amount already paid for an order that cannot be accepted will be refunded without undue delay.

6. ORDERING PROCESS

To submit an order, the Customer must proceed to checkout and enter or confirm the information requested during the ordering process.

Depending on the Customer and the selected delivery method, the required information may include:

  • first and last name;
  • company name, where applicable;
  • billing address;
  • delivery address;
  • country;
  • email address;
  • telephone number;
  • VAT identification number for eligible Business Customers;
  • selected delivery method;
  • selected payment method.

Before submitting an order, the Customer can review and correct:

  • selected products and quantities;
  • billing and delivery information;
  • the selected delivery method;
  • the selected payment method;
  • discounts and promotional codes;
  • the total purchase price;
  • shipping and other additional costs.

By clicking the button clearly indicating an order with an obligation to pay, the Customer submits a binding offer to purchase the products contained in the shopping cart.

An automatically generated email acknowledging receipt of the order confirms only that the order has been received by our technical system.

The automatic acknowledgement does not itself constitute acceptance of the Customer’s offer or conclusion of the sales contract.

The sales contract is concluded when the Seller:

  • sends the Customer an express shipping confirmation, or
  • hands the ordered products over to the carrier for delivery.

The contract is concluded when the first of these events occurs.

The Seller may accept or reject the Customer’s offer within five calendar days after receiving the order.

If the offer is not accepted within that period, it is considered rejected and the Customer is no longer bound by it.

7. PRICES

All prices displayed to Consumers are expressed in euros (EUR or €) and include the applicable value added tax and other mandatory price components, unless clearly stated otherwise.

The applicable VAT rate may depend on the country to which the products are delivered.

The final product price, VAT amount, shipping costs and total amount payable will be displayed before the Customer submits the order.

Prices displayed to registered Business Customers may be shown as net prices excluding VAT where they are clearly identified as such.

Business Customers may receive individual quotations, wholesale prices, volume discounts and separately agreed commercial conditions.

For cross-border business transactions within the European Union, VAT treatment depends on the delivery destination, the Customer’s tax status, the validity of the VAT identification number and the applicable legal requirements.

In the event of an obvious pricing, typographical or calculation error, the Seller may reject the order before the sales contract is concluded.

Prices and promotional offers may be changed for future orders. Changes do not apply retroactively to sales contracts that have already been concluded.

8. PAYMENT

The payment methods available for a particular Customer, delivery country and order are displayed during checkout.

Available payment methods may include:

  • advance payment by SEPA bank transfer;
  • credit or debit card;
  • Visa;
  • Mastercard;
  • Maestro, where supported;
  • American Express;
  • JCB;
  • PayPal;
  • Klarna, where available;
  • Google Pay;
  • Apple Pay;
  • Revolut Pay, where available;
  • payment based on an individual quotation or pro forma invoice;
  • payment by invoice for approved Business Customers.

Not every payment method is available in every country or for every Customer and order.

Only the payment methods displayed during the relevant checkout process are available for that transaction.

When payment by bank transfer is selected, the Customer will receive a payment request or pro forma invoice containing:

  • the recipient’s name;
  • IBAN and, where required, BIC;
  • the amount payable;
  • the order number or payment reference;
  • the applicable payment deadline.

Orders paid by bank transfer are generally processed after the full amount has been received and allocated to the relevant order.

Card and digital-wallet payments may require additional authentication through the Customer’s bank, card issuer or device.

KB SPORT SISTEM d.o.o. and Connect Marketplace do not store complete card numbers or card security codes.

Payment providers may conduct identity, security, fraud-prevention or creditworthiness checks in accordance with their own terms and privacy policies.

If a payment is rejected, the Customer may select another payment method available during checkout.

9. DELIVERY

SKATINGER products are generally dispatched from a warehouse in Croatia.

Delivery is made to the delivery address entered by the Customer during checkout unless otherwise agreed in writing.

The Customer is responsible for providing a complete and accurate delivery address, telephone number and any other information required for successful delivery.

Available delivery countries, shipping methods, shipping costs and estimated delivery times are displayed during checkout.

In-stock products are generally dispatched within seven business days after:

  • the sales contract has been concluded; and
  • payment has been confirmed where advance payment is required.

If a different dispatch period applies to a particular product, it will be displayed on the product page or during checkout.

Delivery may be performed by GLS, DPD or another suitable parcel, courier, freight or logistics provider selected according to the delivery destination, package dimensions and product type.

Partial deliveries may be made where reasonable. Consumers will not be charged additional delivery costs for partial deliveries arranged by the Seller.

Delivery times are estimates and may be affected by:

  • weekends and public holidays;
  • the delivery destination;
  • customs formalities where applicable;
  • transport disruptions;
  • incorrect or incomplete delivery information;
  • events outside the Seller’s reasonable control.

If delivery is delayed, the Customer will be informed as soon as reasonably possible.

Mandatory consumer rights relating to delayed delivery remain unaffected.

10. RECEIPT AND INSPECTION OF THE SHIPMENT

Products are packed to provide reasonable protection during normal transport and handling.

Customers are encouraged to inspect the external condition of the parcel when it is delivered.

If the parcel is visibly damaged, the Customer should, where possible:

  • photograph the damage;
  • ask the delivery person to record the damage;
  • refuse the parcel if the damage is substantial;
  • contact the Seller without undue delay.

Failure by a Consumer to report visible transport damage immediately does not result in the loss of mandatory statutory consumer rights.

Business Customers must inspect delivered products within a reasonable period and notify the Seller of defects or discrepancies without undue delay.

If tracking information indicates that a parcel has been delivered but the Customer has not received it, the Customer should contact us promptly so that the shipment can be investigated.

11. CANCELLATION BEFORE DISPATCH

Before dispatch, the Customer may request cancellation of an order by contacting: info@skatinger.eu.com .

Cancellation is possible only while the order has not been transferred to the warehouse for final processing or handed over to the carrier.

The possibility of cancelling an order before dispatch does not restrict a Consumer’s statutory right of withdrawal.

12. CONSUMER RIGHT OF WITHDRAWAL

Consumers generally have the right to withdraw from a distance contract within 14 days without giving any reason.

The withdrawal period generally begins on the day on which the Consumer, or a third party designated by the Consumer other than the carrier, takes physical possession of the goods.

If several goods ordered together are delivered separately, the withdrawal period begins when the Consumer receives the final item.

To exercise the right of withdrawal, the Consumer must inform the Seller of the decision through an unequivocal statement before the withdrawal period expires.

The Consumer may use the model withdrawal form, but use of that form is not mandatory.

Where an online withdrawal function is available on the Website, the Consumer may also submit the withdrawal statement using that function.

Confirmation of an electronically submitted withdrawal statement will be provided on a durable medium without undue delay.

The Consumer must return the goods without undue delay and no later than 14 days after informing the Seller of the withdrawal.

The Consumer bears the direct cost of returning the goods unless otherwise expressly stated.

Products can generally be returned using a standard parcel delivery service.

The Consumer is liable only for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

GENERAL TERMS AND CONDITIONS

13. LEGAL GUARANTEE OF CONFORMITY

Consumers are protected by the statutory legal guarantee of conformity applicable to goods purchased in the European Union.

The Seller is responsible for a lack of conformity that existed when the goods were delivered and becomes apparent during the applicable statutory period.

Consumers benefit from a minimum statutory protection period of two years from delivery. More favourable mandatory rules in the Consumer’s country of habitual residence remain unaffected.

A product may be non-conforming if, among other things, it:

  • does not match the agreed description;
  • does not have the agreed characteristics or functionality;
  • is not suitable for its normal purpose;
  • is not supplied with agreed accessories or instructions;
  • does not meet reasonable quality, durability or safety expectations.

Where the legal requirements are met, the Consumer may be entitled to:

  • repair;
  • replacement;
  • a proportionate price reduction;
  • termination of the sales contract;
  • compensation where provided by applicable law.

Repair or replacement will be provided free of charge, within a reasonable period and without significant inconvenience to the Consumer, where required by law.

The Consumer may provide an invoice, order confirmation, payment record or another appropriate form of proof of purchase when making a claim.

Statutory rights do not depend on possession of the original paper invoice where the purchase can be proven in another appropriate way.

14. COMMERCIAL WARRANTIES

A manufacturer’s or commercial warranty applies only where it is expressly stated in connection with a particular product or in a separate warranty statement.

The duration, territorial scope, coverage, exclusions and procedure for using a commercial warranty are determined by the relevant warranty statement.

A commercial warranty is separate from and does not limit the Consumer’s statutory rights relating to non-conforming goods.

Unless expressly stated otherwise, a commercial warranty does not cover damage caused by:

  • use contrary to the intended purpose;
  • failure to follow instructions or safety warnings;
  • incorrect inflation pressure;
  • improper storage or maintenance;
  • mechanical damage or external force;
  • normal wear and tear;
  • unauthorised repairs or modifications.

15. PRODUCT COMPLAINTS AND CLAIMS

A complaint or claim concerning a product should be submitted to:

To help us process the claim efficiently, the Customer should preferably provide:

  • first and last name;
  • contact information;
  • order or invoice number;
  • product name and model;
  • a description of the issue;
  • the requested resolution;
  • photographs or videos where relevant;
  • proof of purchase.

We may request that the product be returned or made available for inspection where this is reasonably necessary to assess the claim.

Where a complaint is justified, the Seller will apply the remedy required by applicable law.

16. WRITTEN CONSUMER COMPLAINTS

Consumers may submit a written complaint concerning purchased products, services or the Seller’s business practices by email or post.

Receipt of the written complaint will be acknowledged on a durable medium without undue delay.

The Seller will provide a written response no later than 15 days after receiving the complaint and will clearly state whether the complaint is accepted as justified.

Records of written Consumer complaints will be retained on a durable medium for one year from the date on which each complaint is received.

Consumers habitually resident in another European Union or European Economic Area country retain any more favourable mandatory rights granted by the laws of that country.

17. PERSONAL DATA

Personal data provided during registration, ordering, payment, delivery, withdrawal, return or complaint procedures is processed in accordance with our Privacy Policy.

18. CHANGES TO THESE TERMS OF SALE

The Seller may update these Terms of Sale to reflect changes in applicable law, payment methods, delivery procedures, technology or business operations.

Updated Terms of Sale apply to orders submitted after the updated version takes effect.

Changes do not apply retroactively to sales contracts that have already been concluded.

19. GOVERNING LAW

Sales contracts concluded through the English-language EU online store are governed by the laws of the Republic of Croatia.

Where the Customer is a Consumer habitually resident in another European Union or European Economic Area country, the choice of Croatian law does not deprive the Consumer of the protection provided by mandatory provisions of the law of the Consumer’s country of habitual residence.

Contracts with Business Customers are governed by Croatian law, excluding the United Nations Convention on Contracts for the International Sale of Goods, unless expressly agreed otherwise.
